In January, Senators Markey and Franken, along with Senators Sherrod Brown (D – Ohio) and Richard J. Durbin (D – Ill.), sent a letter to the Centers for Medicaid and Medicare Services (CMS) requesting that CMS reexamine its coverage policies for Medicaid beneficiaries who have been arrested and are in jail awaiting trial. Currently, Medicaid pays for services provided to beneficiaries who are arrested but can afford to post bail—but it does not do the same for those who can’t afford to post bail. Senators Markey and Franken also are working to stop the practice of states terminating inmates’ Medicaid coverage while they are incarcerated, a practice that often prevents individuals from accessing treatment in the critical days and weeks after release.
