MARKEY LAUDS LANDMARK CAR EMISSIONS DECISION FROM VERMONT COURT
WASHINGTON (September 12, 2007) – Today, in a landmark ruling, a Vermont court dismissed automakers’ claims that individual states do not have the authority to set car emissions standards, soundly rejecting the auto industry’s assertions that the standards developed by California and adopted (or in the process of being adopted) by Connecticut, Maine, Maryland, Massachusetts, New Jersey, New York, Oregon, Pennsylvania, Rhode Island, Vermont, Washington, Florida, New Mexico and Arizona are technically or economically infeasible.
Below is the statement of Edward J. Markey, Chairman of the Select Committee on Energy Independence and Global Warming:
“Today’s decision is a landmark in the fight against global warming. Now that the federal district court in Vermont has ruled that the State of Vermont has the authority to implement its version of the forward-looking car emissions standards first adopted by California, it is my hope that the automobile industry will cease fighting these standards in the other States, including Massachusetts, that have adopted them.
“It is time for the Bush Administration and the industry to begin to move forward cooperatively to reduce our dangerous dependence on foreign oil, instead of spending millions of dollars and wasted years on litigation and other stall tactics.
“I call upon the automobile industry to begin to work constructively with Congress to enact a strong 35 mile per gallon fuel economy standard, and call upon the Environmental Protection Agency to expeditiously approve the State of California’s request for permission to immediately implement its standards.”
